By visiting our website and/or purchasing something from us, you agree to be bound by the following Terms of Service ("Terms"), including additional terms and policies referenced herein or available via hyperlink.

These Terms of Service apply to all users of the Site, including but not limited to browsers, vendors, customers, and content contributors.

Please read these Terms of Service carefully before accessing or using our website. By using any part of the site, you agree to be bound by these terms.

Article 1 – Definitions

  • Consumer: The natural person who is not acting for purposes related to their trade, business, craft, or profession.

  • Entrepreneur: The natural or legal person offering products and/or services to consumers via distance contracts.

  • Right of Withdrawal: The consumer’s right to withdraw from a purchase within a specific period.

  • Distance Agreement: An agreement concluded between the entrepreneur and the consumer in an organized system for remote sales.

Article 3 – Applicability

These terms apply to every offer made and every distance agreement concluded between Claire & Marie and the consumer.


Article 4 – The Offer

Offers on our website are non-binding and subject to availability. Prices and product descriptions are provided with care but may contain errors. The consumer has the right to withdraw if incorrect information was used in their decision to buy.


Article 5 – The Agreement

The agreement becomes binding once the consumer has completed the checkout process and received an order confirmation via email. Claire & Marie reserves the right to refuse or cancel orders.


Article 6 – Right of Withdrawal

You have the right to withdraw from your order within 30 days after receiving your product. To exercise this right, contact us via email with your order number and return request. Returned items must be in unused condition and original packaging.


Article 7 – Costs in Case of Withdrawal

The consumer is responsible for the return shipping costs. Refunds (if approved) will be made to the original payment method within 30 days of receipt and inspection of the returned product.


Article 8 – Exclusion of the Right of Withdrawal

The following products cannot be returned:

  • Underwear

  • Lingerie

  • Tights

  • Personal care items
    These exclusions apply for hygienic reasons.


Article 9 – Price

All prices are listed in EUR and include applicable taxes. Claire & Marie reserves the right to change prices at any time, but not retroactively after an order is confirmed.


Article 10 – Conformity and Warranty

Products must meet the reasonable expectations set by the offer and product description. If an item is defective or not as described, the consumer may request a replacement or refund.


Article 11 – Delivery and Execution

We aim to deliver within 8–12 working days after order processing. Delays will be communicated by email. If a product becomes unavailable, the consumer will receive a refund or suitable alternative.


Article 12 – Duration Transactions

There are currently no subscription or long-term contracts. If such products are offered in the future, the terms for renewal or cancellation will be clearly communicated.


Article 13 – Payment

Payment is due immediately upon placing an order. Accepted payment methods include credit card (AMEX, Mastercard, Maestro, Visa), bank transfer, EPS, and others offered at checkout. Non-payment may result in order cancellation.


Article 14 – Complaints Procedure

Complaints must be submitted in writing to info@clairesboutique-montréal.com with a clear description of the issue and order number. We will respond within 14 days. If a solution is not found, the consumer may escalate to a dispute resolution body.


Article 15 – Disputes

This agreement is governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, unless otherwise required by applicable consumer protection law.
